These terms govern use of this website and purchases from Brushed Serenity. By using the site or completing an order, you agree to them.
This website is operated by Brushed Serenity and Shivani Khanna Vohra. Questions, notices, and requests may be submitted through the contact form.
Original paintings are generally one-of-one works. An item placed in a cart is not guaranteed until Stripe confirms payment. Brushed Serenity may reject or cancel an order for suspected fraud, pricing or listing errors, inventory conflicts, export or shipping restrictions, or other lawful reasons. If payment was captured for an order that cannot be fulfilled, the affected amount will be refunded.
Prices are stated in United States dollars unless otherwise shown. Stripe processes payment information. Shipping, applicable taxes, and valid promotion codes are shown during checkout. A discount has no cash value, may be limited or withdrawn, and cannot be combined unless expressly permitted.
Brushed Serenity accepts only payment methods offered through its authorized checkout. No artwork, license, refund, credit, or other value will be exchanged for cryptocurrency, tokens, NFTs, or other blockchain-based assets.
Insured shipping is calculated at checkout based on the order. Buyers must provide a complete and accurate address. Delivery estimates are estimates, not guarantees. Risk of loss transfers as permitted by applicable law when the carrier accepts the package, subject to any carrier claim and consumer rights that cannot legally be waived.
If shipment cannot occur within the stated period, Brushed Serenity will communicate the delay and provide any cancellation or refund option required by applicable law.
Because each work is an original, completed sales are generally final except where required by law or where the artwork is materially not as described. A cancellation request made before shipment will be reviewed but is not guaranteed once preparation has begun.
Transit damage must be reported promptly, preferably within 48 hours, with photographs of the unopened package, exterior damage, all packing materials, the shipping label, and the artwork. Keep all materials until the carrier claim is resolved. Failure to preserve evidence may limit available remedies.
Purchasing a painting transfers ownership of the physical object only. Copyright and all reproduction, adaptation, distribution, display, licensing, merchandising, image, and derivative-work rights remain with Shivani Khanna Vohra unless a separate written agreement, signed by the rights holder, expressly transfers specific rights.
Ownership of the physical painting does not authorize commercial photography, prints, merchandise, advertising use, AI training, dataset inclusion, tokenization, minting, fractionalization, or creation or sale of an NFT or other blockchain-linked representation.
You may not copy, scrape, download in bulk, reproduce, alter, remove watermarks, republish, sell, license, tokenize, mint, train an artificial-intelligence system on, or create derivative works from any artwork, photograph, writing, logo, or site content without prior written permission.
Unauthorized use may result in removal demands, account or order cancellation, preservation of evidence, platform or hosting complaints, takedown notices, claims for injunctive relief, actual damages, infringer profits, statutory damages where available, costs, attorneys’ fees where recoverable, and other civil or criminal remedies permitted by law. Brushed Serenity reserves all rights and does not waive a violation by delaying enforcement.
Testimonials are published only with permission or a reasonable basis to believe the contributor approved publication. A person who submits text or a photo for publication confirms that they have the right to provide it and grants Brushed Serenity a nonexclusive, revocable permission to display it for studio marketing. A removal request may be submitted through the contact form.
The website may be changed, interrupted, or unavailable. Stripe, Cloudflare, Resend, carriers, and other providers operate under their own terms. Brushed Serenity is not responsible for third-party outages or conduct beyond its reasonable control.
To the fullest extent permitted by law, the site and its content are provided without warranties beyond those expressly stated. Brushed Serenity is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from site use or a purchase. Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded.
These terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law principles. Subject to any nonwaivable consumer right, disputes will be brought in a court of competent jurisdiction in New Jersey. Before filing a claim, the parties are encouraged to attempt good-faith resolution through the contact form.
If any provision is unenforceable, the remaining provisions remain effective. These terms, together with the posted privacy, cookie, shipping, and return policies and any written order-specific agreement, form the agreement governing the transaction. Updates apply prospectively from the date posted unless law requires otherwise.
